Insurance Requirements Guide: Permitted Athletic Facility Use
Provide proof of a current insurance policy including: (Refer to appropriate user group classification)
Insurance Requirements are determined by Risk Management Department and subject to change.
Youth Sport Providers
- Commercial General Liability: Permittee shall maintain Commercial General Liability at a limit of liability not less than $1,000,000 Each Occurrence. Coverage shall not contain any endorsement(s) excluding nor limiting Premises/ Operations, Personal Injury, Product/Completed Operations, Contractual Liability, Severability of Interests or Cross Liability. Coverage shall be provided on a primary basis. General Liability includes: (must be shown on the certificate)
- Damage to Rented Premises, $50,000 each occurrence
- Personal & ADV Injury, $1,000,000
- General Aggregate, $1,000,000
- Product Liability, $1,000,000 – this is required for food being provided for free as well as products for sale.
- Sexual Abuse/Molestation, $250,000
- Participant Legal Liability, $25,000 minimum (this must be shown on the certificate)
- Workers’ Compensation Insurance & Employer’s Liability
- Must maintain in accordance with Chapter 440 of the Florida Statutes.
- If less than 4 employees, a Certificate of Exemption is required, or letter signed by owner/officer stating you have less than 4 employees, have chosen not to purchase workers’ compensation insurance and agree to do so should additional employees be hired in accordance with Chapter 440 of the Florida Statutes.
- Automobile Liability (if applicable)
- Non Transportation Related: If permit holder operates/moves a vehicle or trailer while a permitted program or event is actively in progress, then auto liability is required at $500,000 combined or $100,000/$500,000. This is not required if vehicles and/or trailers remain in place and at no time are moved while the permitted program or event is actively in progress. Vehicles and/or trailers, which have elected to remain in place in lieu of liability coverage may be moved if directed by emergency authorities or Parks personnel without additional liability.
- Transportation Related: If transportation is being provided, then $1,000,000 worth of coverage is required.
- Unmanned Aircraft Liability Coverage (if applicable)
- Drones may be flown in designated areas only and/or by special permit.
- Commercial Operations of Drones require a minimum of $1,000,000 separate from general liability, and provided as a separate policy and clearly state Unmanned Aircraft Coverage.
- Other specialized insurance may be required depending on activity.
- Palm Beach County Board of County Commissioners must be listed as Additional Insured if using Palm Beach County Parks and Recreation facilities. If listed as “Additional Insured per written contract”, it must be revised to state “Additional Insured per written contract or agreement”.

Adult Sport Providers

- Damage to Rented Premises, $100,000 each occurrence
- Personal & ADV Injury, $1,000,000
- General Aggregate, $2,000,000
- Product Liability, $1,000,000 – this is required for food being provided for free as well as products for sale.
- Sexual Abuse/Molestation, $250,000
- Participant Legal Liability, $25,000 minimum (this must be shown on the certificate)
- Workers’ Compensation Insurance & Employer’s Liability, minimum statutory limits of $100,000/$100,000/$500,000
- Maintain in accordance with Chapter 440 of the Florida Statutes. Required Endorsements: Waiver of Subrogation – WC 0003 13 or its equivalent. (Required if employees provide work in conjunction with the facility use.)
- If less than 4 employees, a Certificate of Exemption is required, or signed letter on letter head stating: “I, (Name), (Title) of (Organization Name) with fewer than four employees, have elected to opt out of Workers’ Compensation coverage pursuant to Florida Statutes Chapter 440. I acknowledge my responsibility to comply with Florida Statures Chapter 440 and all other applicable regulations. Further, I understand that I am an independent contractor and not an employee of the School Board of Palm Beach County. I agree that under no circumstances shall the School Board of Palm Beach County be responsible for any Workers’ Compensation benefits for injuries or illnesses that I may suffer while working under this agreement.”
- Business Automobile Liability
- If owned commercial autos are used on Board Facilities: Minimum coverage of $500,000 per occurrence. This coverage shall be an “Any Auto” form policy.
- If User Group does not own any commercial vehicles: Minimum coverage of $500,000 per occurrence. This coverage shall be “Hired and Non-Owned Coverage”. In addition, an affidavit signed by the awarded proposer: “(Company Name) does not own any vehicles. In the event the company acquires any vehicles throughout the term of the contract, (Company Name) agrees to purchase “Any Auto” coverage as of the date of acquisition.”
- Other specialized insurance may be required depending on activity.
- Two (2) separate Certificates of Insurance required: One (1) for Palm Beach County Board of County Commissioners and One (1) for School Board of Palm Beach County.

Governmental Entities
Government entities requesting use of Palm Beach County Parks and Recreation facilities must provide written confirmation of their self-insured status or sovereign immunity coverage. Acceptable proof must be provided on the agency’s letterhead and be issued by the agency’s Risk Management Department. The letter must:
- Confirm the agency is self-insured or covered under sovereign immunity pursuant to Florida Statutes 768.28.
- Identify the agency by full legal name (e.g. The School Board of Palm Beach County).
- State that the self-insured status provide coverage equivalent to standard liability insurance for the activities conducted on Palm Beach County property.
- Be signed and dated by an authorized representative of the Risk Management Department.

Food & Beverage Concessions | Food Trucks | Merchandise Sales

- Liquor liability insurance in the amount of $1,000,000 and a liquor license is required if alcohol is sold and must be secured by the party selling the alcohol.
- If alcohol is being provided free of charge by the host organization, then a liquor license is not required, but liquor liability insurance in the amount of $1,000,000 is required.
- If alcohol is being provided free of charge by a third party vendor, then a liquor license is not required, but both the host organization and the third party vendor must have liquor liability insurance in the amount of $1,000,000.
- Other specialized insurance may be required depending on activity.
- Palm Beach County Board of County Commissioners must be listed as Additional Insured if using Palm Beach County Parks and Recreation facilities. If listed as “Additional Insured per written contract”, it must be revised to state “Additional Insured per written contract or agreement”.
