A. ADMINISTRATION
1. Staff
requests Board Direction: regarding a potential redistricting involving Districts 2 and 7 in the
Century Village community. SUMMARY: Pursuant to direction given at the
Board of County Commissioners (BCC) workshop meeting on October 28, 2025, the
BCC directed staff to bring back additional information regarding a potential
minor BCC district change. The subject
area is a small portion of Century Village north of a canal which otherwise
serves as the northern boundary of Century Village. This portion contains 119 residents. Attached to this item are three (3) maps
identifying the distinct area, as well as, the populations impacted.
In any redistricting attempts, to maintain municipal and community
contiguity are given great consideration.
In the most recent BCC redistricting adopted in 2021, numerous district
boundaries were drawn respecting this practice.
In the case of this presentation where a distinct residential community
is separated into two (2) different Commission Districts, it is appropriate to
maintain them in one (1) district. In 2021 the aforementioned canal served as
the District break, thus dividing the Century Village
community. Should the BCC direct staff to proceed with this change, there are a number of
steps that will be taken. Florida
Statutes require that changes be made no later than 270 days prior to the next
general election. This sets a deadline
of February 6, 2026. An Ordinance
amending the Commission District boundaries would be presented to the BCC on
January 6, 2026. The BCC would adopt the
new boundaries on January 22, 2026, at the BCC Zoning meeting. Following adoption, Florida Statutes requires
advertising a certified copy of the Ordinance for two (2) consecutive
weeks. Staff would recommend utilizing
the consultants used in 2021, as well as, previous BCC
redistricting efforts dating back to 2000.
Stephen Cody and Jerry Wilson specialize in election law and political
redistricting. They are uniquely
familiar with Palm Beach County having performed these services and can respond
to this expedited schedule. Staff would
seek approval of their contract at the January 6, 2026, meeting. Districts 2

1. Staff recommends
motion to approve: a Memorandum of Understanding (MOU) between Lively Technical
College and Palm Beach County (County), by and through its Board
of County Commissioners (BCC), to provide use of the Palm Tran Maintenance
facilities for participants of the Florida Department of Transportation (FDOT)
and Lively Technical College Florida Transit Technician Program (FTTP). Summary: This MOU establishes a partnership between
Lively Technical College and County to utilize Palm Tran’s maintenance facilities
as a training site for the FTTP. The MOU supports
hands-on instruction for technicians and trainees, enhancing workforce skills
in key areas of bus maintenance and operations at no cost to County. Technicians and Trainees program participants
may come from other Agencies outside of County.
These Participants and Participating Agencies will be required to sign a
Release of Liability and Workers’ Compensation Certification as a condition of
participating in the program at Palm Tran.
This requires Participants and their Participating Agencies to release
and hold harmless Palm Tran, County, and their respective officers, employees,
agents, and affiliates from any and all claims, liabilities, damages, or
injuries (including death) that may arise out of or in connection with the
Participant’s attendance, participation, or presence at the Palm Tran
Instruction Site. The certification also
requires Participating Agencies to certify that all maintenance technicians
attending training at Palm Tran’s Instruction Site are covered under the
Participating Agency’s workers’ compensation insurance policy during the entire
duration of their training. Countywide

1. Staff requests
direction: on which legal option to proceed with, relative to the flight restrictions implemented by the
Federal Aviation Administration (FAA) on October 20, 2025, at Palm Beach
International Airport (PBI). Summary: On November 18, 2025, during the Board of
County Commissioners (BCC) meeting, Commissioner Weiss directed the County
Attorney’s Office (CAO) to provide legal options relative to the recently
implemented flight restrictions at PBI.
Effective October 20, 2025, the FAA prohibited all operations within a
one (1)-mile radius of Mar-A-Lago below 2,000 feet at all times, except where authorized by air traffic control. This restriction remains in effect 24 hours a
day, 365 days a year, through October 20, 2026.
As a result of the restriction, all departures from PBI to the east are
being directed to turn toward the northeast upon departure to avoid the
restricted airspace over Mar-A-Lago.
This has resulted in a substantial increase in overflights experienced
by residents of El Cid, Flamingo Park, and the Town of Palm Beach. Staff requests direction as to which legal option the BCC would like to
proceed with relative to the flight restrictions. The first option,
would be to commence formal legal challenge against the FAA by filing a
petition for review, which must be filed by December 12, 2025. However, staff would still attempt to engage
the FAA in conversations under this scenario.
The second option, would be to continue to request discussions with the
FAA and United States Secret Service (USSS) regarding potential modifications
to the flight restrictions without initiating formal legal action. This option
would result in the County losing any opportunity to file a formal legal
challenge to the flight restrictions if there are no opportunities for
conversation with the FAA and/or USSS or if the conversations are not
